TRADING CARS UK LTD – Terms of Business and Conditions of Sale

1. Nature of Service

TRADING CARS UK LTD operates as a used car broker, introducing buyers and sellers. We do not own the vehicles and are not a seller. All transactions are directly between the buyer and supplying dealership. Our role is limited to facilitating introductions and assisting with communication.

2. Vehicle Condition and Checks

  • All vehicles listed by suppliers are intended to be HPI clear and free from outstanding finance. However, buyers are strongly advised to carry out their own independent checks, such as V Check, before completing any purchase.
  • Buyers are responsible for verifying the accuracy of the vehicle’s description, including mileage, condition, keys, service history, and any other relevant details.
  • TRADING CARS UK LTD does not provide any warranties, guarantees, or representations as to the condition, mileage, or legal status of any vehicle.

3. Sale Agreement

  • Upon introduction, TRADING CARS UK LTD will issue a sale agreement to both parties confirming vehicle details, mileage, number of keys, service stamps, and agreed price.
  • Buyers are responsible for reviewing and confirming the accuracy of the sale agreement. Any discrepancies should be raised immediately with the supplying dealership.

4. Payment and Collection

  • Payment is to be made directly to the supplying dealership, typically by bank transfer, prior to collection or delivery.
  • Vehicles should be collected within five working days of the invoice date, unless alternative arrangements are agreed. Delivery can be arranged at the buyer’s cost.

5. Trade Sale Acknowledgement

  • All vehicles are sold as trade sales, not retail sales. Trade sales assume the buyer has the expertise and knowledge to assess the vehicle before purchase.
  • Buyers acknowledge that the Sale of Goods Act 1979 (as amended) and the Consumer Rights Act 2015 allow parties to agree terms excluding implied warranties, provided this is done fairly and transparently.
  • Any issues identified after purchase that were not disclosed by the supplying dealership should be reported promptly. TRADING CARS UK LTD will facilitate communication but is not liable for resolving disputes.

6. Mechanical and Cosmetic Condition

  • Vehicle descriptions include cosmetic condition (interior and exterior) and known mechanical issues exceeding a £300 soft prep allowance (unless otherwise stated).
  • Buyers should conduct their own inspections and road tests where possible. Vehicles are purchased at the buyer’s risk. TRADING CARS UK LTD is not liable for post-sale mechanical or cosmetic issues.

7. Mileage and Records

  • TRADING CARS UK LTD cannot verify the accuracy of mileage or odometer readings. Buyers must satisfy themselves as to the correctness of any records.

8. Liability

  • TRADING CARS UK LTD is not responsible for any misdescription, defects, or disputes between buyers and supplying dealerships.
  • In case of disputes, TRADING CARS UK LTD may assist in facilitating communication between the parties, but any resolution, compensation, or remediation is solely the responsibility of the buyer and supplier.

9. Legal Position

  • These terms form the agreement between the buyer and supplying dealership for the purposes of any transaction.
  • By proceeding with a purchase, the buyer acknowledges that the sale is made without warranty, either expressed or implied, and agrees to assume full responsibility for due diligence.
  • Where applicable UK law permits, these terms exclude TRADING CARS UK LTD from liability in respect of the condition, description, or fitness for purpose of the vehicle. Nothing in these terms affects statutory rights that cannot be excluded under UK law.
